সর্ব প্রথম ভারতীয় উপমহাদেশে আইন প্রণয়নের জন্য আইন কমিশন গঠন করা হয়। কমিশনের চেয়্যারম্যান ছিলেন Lord Macaulay এবং G.W Anderson ও কমিশনের কমিশনার ছিলেন J.M Macleod এবং F. Millet. ১৮৩৭ সালে এই কমিশন দন্ডবিধি প্রণয়নের জন্য প্রথম খসড়া জমা দেন এবং ১৮৬০ সালের ৬ অক্টবর বিলটি পাস করা হয়। ১৮৬২ সালের ১লা জানুয়ারী থকে দন্ডবিধি কার্যকর করা হয়।
দন্ডবিধি অপরাধ সংক্রান্ত একটি মৌলিক বা তত্ত্বগত আইন যাকে ইংরেজিতে (Substantibe Law) বলা হয়ে থেকে। দন্ডবিধি ১৮৬০ সালের ৪৫নং আইন। এটি প্রথমে (ইন্ডিয়ান পেনাল কোড) নামে পরিচিত ছিল। ১৯৪৭ এর পরে পাকিস্তান পেনাল কোড নামে পরিবর্তন করা হয় যা পরবর্তিতে বাংলাদেশ স্বাধীন হওয়ার পরে ৩০/০৬/১৯৭৩ সালে শুধু পেনাল কোড নামে পরিচয় লাভ করে।
মুল পেনাল কোডের ধারা ছিল ৪৮৮টি বর্তমানে এই আইনে ধার আছে মোট ৫১১ টি এবং অধ্যায় আছে মোট ২৩ টি।

                         In the first Indian subcontinent a law commission was formed to legislate. The chairman of the commission was Lord Macaulay and G.W Anderson and the commissioners of the commission were J.M Macleod and F. Millet. The commission submitted its first draft for enforcing penal code in October 3 and the bill was passed on October 5. The penal code was implemented on January 1 12 th.
The Penal Code is a fundamental or doctrine of crime called the Substantibe Law. Penal Code No. 1 of 5. It was formerly known as (Indian Penal Code). It was later renamed as Pakistan Penal Code which became known as Penal Code only on 1/3/5 after Bangladesh became independent.
The original Penal Code was made up of 5 sections currently under the Act and there are a total of 20 chapters.
